By accessing www.mypicturegallery.com, or using the My Picture Gallery Android or iOS app, operated by My Picture Gallery LLC, you acknowledge and agree to the following terms. Hereafter, “My Picture Gallery” will refer to the website, mobile applications, and services provided by My Picture Gallery LLC.
Terminology Clarification
For the purposes of this document, the terms “Photos”, “Images”, and “Media” are used interchangeably and all refer to visual content uploaded or shared on the platform.
User Responsibilities
Users must comply with all applicable laws and regulations while using “My Picture Gallery.” They are responsible for maintaining the security of their accounts, ensuring they have the necessary rights to upload content, and refraining from unauthorized, abusive, or disruptive activities. Any misuse of services, including violation of Terms and Conditions, may result in account suspension or termination.
Account Security
Users must protect their login credentials and are responsible for any activities occurring under their account. If an account is compromised, “My Picture Gallery” reserves the right to temporarily suspend or secure it to prevent further risks.
Ownership of Uploaded Images
“My Picture Gallery” recognizes that all images uploaded to an account remain the exclusive property of the account holder, who retains full legal rights over their content. Account holders have complete control to view, download, upload, or remove their images as needed. If an account holder grants access to others to upload images to an Album or Event within their account, the account holder retains ownership of all uploaded content and is solely responsible for ensuring compliance with legal and platform guidelines. “My Picture Gallery” is not liable for any images, videos, or media stored within an account, regardless of who uploads them. “My Picture Gallery” does not claim copyrights or ownership over any uploaded content.
Account holders and authorized users who upload images must ensure they possess the necessary rights to upload and share content. Any material that violates intellectual property laws will be removed, and repeated infractions may lead to account suspension.
Authorization for Image Processing and Access
By uploading images, you grant “My Picture Gallery” permission to display uploaded images from your account to end users, guest, or attendee in reduced picture quality for faster viewing, conduct facial recognition searches, evaluate image sharpness, quality, and features, and provide download access to end users, guest, or attendee. If you grant others access to upload images within your account, you acknowledge that all uploaded images are subject to the same processing and accessibility permissions. Additionally, you authorize end users, guest, or attendee to print images from your account, regardless of whether the images were uploaded by you or by an authorized contributor.
Face Recognition and Image Matching
“My Picture Gallery” offers face recognition services, including selfie matching and image searches using uploaded photos. By using these features, account holders and authorized users acknowledge that uploaded images may be processed to identify and match faces based on system algorithms. If an account holder grants access to others—such as end users, guest, or attendee —those users can also utilize these features within the shared account.
All users who upload images for facial recognition searches grant “My Picture Gallery” permission to analyze and compare images solely for search and recognition purposes within the platform. Facial recognition data is not shared with third parties unless required by law or expressly authorized by the account holder. While we strive for accuracy, “My Picture Gallery” does not guarantee perfect matches and is not liable for any misidentifications or errors in the recognition process
Privacy & Data Usage
“My Picture Gallery” collects and processes user data, including images, facial recognition searches, and account information, strictly for service-related purposes. We do not sell personal data to third parties. Users acknowledge that while we take security measures, no system is completely immune to risks, and they accept responsibility for their data.
Payment Processing
By purchasing any subscription or service through My Picture Gallery, you agree that all credit card transactions will be processed by our designated payment processor. You authorize the payment processor to charge your selected payment method. My Picture Gallery does not store or have access to your complete payment card details. Your use of the payment processor’s services is governed by their user agreement and privacy policy.
Refunds & Cancellation Policy
All subscriptions are subject to a minimum charge of one month. Refunds are not applicable for partial months, and cancellations will take effect at the end of the current billing cycle. Printing fees are non-refundable once an order is submitted. Users agree to these payment terms upon subscribing to any paid service.
Content Removal Policy
Account holders, including those who grant access to others to upload or share images within their account, are solely responsible for all photos, videos, or media stored under their account. “My Picture Gallery” reserves the right to remove any content at its discretion, including material that violates the Terms of Use, contains pornographic, illegal, or disturbing content, or is otherwise deemed inappropriate. Additionally, “My Picture Gallery” may delete images that infringe copyright, violate intellectual property rights, include hate speech, illegal content, or other restricted material. If content is uploaded by an authorized user of the account without appropriate consent or in violation of legal requirements, it may also be subject to removal, and the primary account holder remains responsible for compliance.
Account Removal and Data Retention
“My Picture Gallery” reserves the right to remove accounts that are unsubscribed, inactive, or free-tier accounts at its discretion. Free accounts may be subject to deletion without prior notice, and unsubscribed users who no longer maintain a paid plan may lose access to stored images, media, and associated services.
When an account is removed, “My Picture Gallery” will take reasonable measures to delete all associated images and media. However, due to technological limitations, certain residual data or files may remain on our servers and backups beyond active deletion efforts. “My Picture Gallery” does not guarantee the absolute removal of all data and is not liable for any remaining files that may persist unintentionally.
By using our platform, users acknowledge that continued access to services requires an active paid subscription, and failure to maintain one may result in account termination. Additionally, users agree that “My Picture Gallery” is not responsible for any leftover data following account removal.
Termination of Account
“My Picture Gallery” reserves the right to suspend or terminate an account at its discretion, with or without prior notice, if the account holder or any authorized users violate our Terms of Use, engage in fraudulent or unauthorized activities, or upload content that is illegal, harmful, or otherwise deemed inappropriate. Additionally, failure to comply with content policies, payment obligations, or security guidelines may result in account termination. Upon termination, access to stored images, media, and related services will be revoked, and “My Picture Gallery” is not responsible for any loss of content or data.
Pricing Changes
“My Picture Gallery” reserves the right to adjust pricing for printing services and subscription plans at any time, with or without prior notice. These changes may apply to new and existing users, including ongoing projects that have not yet been submitted for order. Prices are subject to fluctuation based on various factors, including market conditions and service updates. By using our platform, you acknowledge that pricing adjustments may occur and agree to the applicable rates at the time of purchase or service usage.
Discontinuation of Products and Services
“My Picture Gallery” reserves the right to modify, suspend, or discontinue any product, service, or subscription plan at any time, with or without prior notice. Such changes may be implemented due to business needs, market conditions, or improvements to our platform. If a product or service is discontinued, existing users may be notified regarding any impacts on their active plans or purchases, where applicable. “My Picture Gallery” is not liable for any inconvenience or loss resulting from such discontinuations.
Prohibited Conduct and Enforcement
“My Picture Gallery” maintains a zero-tolerance policy for users who engage in abusive, fraudulent, or illegal activities, including but not limited to spamming emails, threatening employees, agents, associates, or other representatives, or violating applicable laws. Any user found to be engaging in such behavior may have their account suspended or terminated without prior notice. Additionally, “My Picture Gallery” reserves the right to take further action, including reporting violations to the relevant authorities. By using our services, all users agree to abide by ethical and legal standards, and failure to comply may result in restricted access or permanent removal from the platform.
Printing Authorization
By maintaining an account with “My Picture Gallery,” the account holder grants “My Picture Gallery” the legal right to facilitate the printing of images from their account upon request by an end user, guest, or attendee. The printing service is subject to applicable fees, which will be charged directly to the end user, guest, or attendee requesting the prints. The account holder acknowledges and agrees that “My Picture Gallery” may process such transactions without requiring further consent from the account holder. The account holder waives any objection to the printing process and associated charges applied to the end user, guest, or attendee.
Third-Party Content & Integrations
While “My Picture Gallery” may integrate with third-party services, including camera tethering, we do not guarantee flawless compatibility across all devices. Some cameras may not support tethering due to technical limitations, and even compatible models may experience issues due to dependencies on external technologies. Users acknowledge that third-party integration is offered as-is, without warranties.
Service Availability & Downtime
While we strive to maintain reliable access to “My Picture Gallery,” service availability may fluctuate due to scheduled maintenance, updates, or unforeseen technical failures. Additionally, unplanned outages or emergency maintenance may occur without prior notice. “My Picture Gallery” is not liable for any downtime, interruptions, or related losses users may experience as a result of these service disruptions. Users acknowledge that access to services is subject to these potential events and agree that “My Picture Gallery” is not responsible for any inconvenience or impact on usage.
Liability Waiver
“My Picture Gallery” provides its services on an “as-is” and “as-available” basis, without any warranties or guarantees regarding performance, availability, or uninterrupted access.
By using our platform, you acknowledge that “My Picture Gallery” is not responsible for any issues arising from the use or inability to use our services, including but not limited to technical failures, data loss, unauthorized access, or disruptions. To the fullest extent permitted by law, “My Picture Gallery” disclaims all liability for any direct, indirect, incidental, or consequential damages, including but not limited to loss of profits, business interruptions, or reputational harm. Users accept full responsibility for their content and any interactions within the platform, and “My Picture Gallery” shall not be held liable for any disputes or claims resulting from usage.
Indemnification Clause
Users agree to indemnify and hold “My Picture Gallery” harmless against any claims, liabilities, damages, or legal disputes arising from their usage of the platform, including unauthorized content uploads, violations of laws, or misuse of services
Governing Law & Dispute Resolution
Any legal disputes related to the use of “My Picture Gallery” will be governed by the applicable laws of the company’s registered jurisdiction. Disputes must be resolved through arbitration or legal proceedings in the designated jurisdiction.
Changes to Terms & Conditions
“My Picture Gallery” reserves the right to update, modify, or amend these Terms and Conditions at any time, with or without prior notice. Changes may be implemented due to business needs, legal requirements, service enhancements, or evolving industry standards. Users are responsible for regularly reviewing the Terms and Conditions to stay informed of any updates. Continued use of the platform after modifications signifies acceptance of the revised terms. “My Picture Gallery” is not liable for any inconvenience or loss resulting from unawareness of such changes.
